I filed my claim via mcol at the beginning of june. I received notification from Northampton county court on 5th July that my case was being transferred to my local county court. I then received notification from my local cc that all parties should send bundles to each other and the court by 12th July, tomorrow. I took my bundle into the court office personally and sent abbey theirs via Royal Mail special delivery. Yesterday, I phoned the court regarding THE letter from abbey, just to find out if my claim was stayed and during the conversation with the lad on the phone, I mentioned that I still had not received abbey's bundle. The young lad, who incidentally, took my bundle off me, told me that they had received abbey's bundle.
When the claim is heard on 17th Sept, I'll have no idea what abbey's evidence will be. Can anyone please tell me where I stand on this. As yet, I have not written to abbey requesting their bundle. |

This is a major first, i would contact the court tomorrow and confirm with someone else that it is deffiniatly the bundle they have submitted, if it is deffinatly there bundle and not simply a letter requesting stay then, you need to have a copy of this bundle immediately.
I think mods should be aware of this, this is potentially very important progress. Wonder why they now decide to send a bundle, is there a new statergy appearing instead of Abbey doing the usual and sticking there fingers in their ears and there heads in the sand.
Although i think that they have still failed to comply with the order if they havent sent a copy to you, not sure if you are able to get a copy from the courts.
Did the court say when they received it, seems a bit odd that they would send a bundle in despite the OFT announcement, surely they csnt be wanting to fight it with the test case ongoing.

This is aboslutey correct advice, when you have checked with the court tomorrow that it is indeed a bundle they have received and you still haven't received yours then come back and we will give futher advice. |

I called in to the Court office this after-noon to submit my application for judgement for abbey's non-compliance. I spoke to the court manager and asked her for a copy of abbey's bundle. I told her that I was informed last week during a phone call that abbey had submitted one. She confirmed that abbey had NOT submitted any documents other than their defence. I'm sorry if I got the young lad who I spoke to during the telephone conversation in trouble but, I had to ask the court manager if she could imagine the stress that conversation had caused me over the weekend.
Just to clarify.....abbey have NOT submitted their bundle after all.
Given that the deadline for abbey to submit their bundle has passed, I wonder if the court will enter a judgement for me. I live in hope!!!  |
