Hi, if you received a letter from Abbey it will be stating that they are going to ask the court for a stay, the stay depends entirely upon the court in question, but as most of them are granting the stays then it is a fair bet that yours will too, but in the meantime, adhere to any deadlines set or any court orders.

Hope this helps

Hi m3lavo,
My Sis in Law is in the same Court(Biffs Sis in Law v Abbey).

N1 sent and claim issued 19.07.07
Defendant filed Acknowledgement of Service on 3.08.07
Abbey sent standard letter about "asking Court for stay" 7.08.07

Awaiting decision from court. Will keep you informed.

Just one question "Is it worth asking for the stay to be removed?"

Biff
