Red face N.Ireland Matt v abbey

Just about to start small claims against abbey. done the prelim and the LBA got the usuall delays and good will gesture. Not good enough. I just have a few questions, wondered if anyone can help.

1. Anyone experience of small claims online in N.I. any sucessful claims here.
2. Is ther a n.ireland section on the CAG forums, i cant find one
3. This is my wifes account does she have to fill in the claim and go to court herself or can i do that on her behalf.
4. Had a computer crash and lost the prelim letter and i dont know the date will i need this if we go to court. Still have a copy of the LBA

Very nervous about going to the court step any help will be appreciated.

Hi Matt

Q1 - Can't help you on that one, sorry.

Q2 - Does this link help?

Northern Ireland Small Claims Guide and new NI online claims service

Q3 - As far as I am aware you can claim on behalf of someone else, but I am not 100% sure. It is possible that the guides in the above link may give you an answer. (Or in the FAQ's on this site.)

Q4 - Bit of a tricky one - my turn to ask questions:

Did you use the template letter from here for your Prelim?
And did you send it Recorded Delivery or similar? In which case the date of receipt should be checkable, and I would assume that the letter was dated the day before?

If yes to both, then you should be okay reproducing it, back-dating it to the day before receipt, in my personal opinion.

The Prelim letter should form part of your Court bundle, but you are a long way off from that, and may not have to produce one.

Hope that helps a bit, but don't take any of what I have said as gospel - have a look at the A-Z guide, and the FAQ's, for more guidance.

Thanks for the info jo, unfortunatley i had the crash between prelim and LBA i can roughly guess the date but i just want to know if i needed for the court bundle, which as you say i do.
And yes the ourt guide link was very useful

I used the Small Claims online facility in NI and was successful about 4 months ago. The online facility is excellent and you will be guided throughout so don' t worry about using it.

I got to the stage of getting a court date and was then contacted by Abbey's solicitors (Arthur Cox) who settled a few days before the court date despite having sent me the standard defence.

So in summary, do go ahead and register online and take your case forward that way as it is really easy. I don't think there is NI section of CAG but you won't need one cos the people on here are excellent and always give good advice and support.

And don't worry too much about the prelim letter - I don't think you will get to the point of seeing a judge.
